Robbery
An act of robbery is similar to theft and occurs when the defendant exerts control over the property of another through the use of force or the threat of force. The penalties for robbery are severe. These penalties may be enhanced if any of the following occur under the 10-20-life statute:
- If convicted for pulling a gun during the commission of the robbery; mandatory minimum of 10 years in prison.
- If convicted for firing a gun during the commission of the crime; mandatory minimum of 20 years in prison.
- If convicted of injuring or killing the victim during the commission of the crime; mandatory minimum of 25 years to life in prison.
I recently represented a client charged with Robbery and Aggravated Battery after he and his friends allegedly beat the victim the then stole his watch and cell phone.
