Disorderly Intoxication

Disorderly Intoxication is an extremely common charge and punishable as a second degree misdemeanor (punishable by not more than 60 days jail and not more than $500 fine). Police use this charge as a basis to arrest when no other crime fits the situation. Therefore, it is said to be a "catch all." The statute is very vague and therefore vests a great deal of discretion in the hands of the arresting officer. Moreover, those arrested and charged with Disorderly Intoxication are often confused as to why they were arrested and believe they did nothing wrong.
